These terms explain the rules for orders placed on facutedinlemn.ro. Statutory consumer rights cannot be excluded or restricted by these terms.
Orders and the sales contract
An online order concerns the purchase of the selected products. The distance sales contract does not require a customer account or a separately signed document. Before submitting an order, you can review and correct the products, contact and delivery details, and payment method. Submitting an order creates an obligation to pay the displayed total. Automatic acknowledgement of receipt of an order does not by itself mean acceptance; order acceptance and contractual information are communicated by email. Keep the confirmation and order number to identify the purchase.
Intellectual property
The texts, photographs, logos and other materials on the website are protected under copyright law. Their reproduction or commercial use requires the rights holder's consent, subject to legally permitted exceptions.
Handmade products
Characteristics, dimensions, price and availability are shown on each product page. The grain, shades and natural characteristics of wood may vary as described and shown in the photographs. These characteristics do not remove the obligation to deliver a product that matches its description and is fit for its intended use. A product being one of a kind or handmade does not exclude the legal guarantee or the right of withdrawal. Updates to descriptions and prices for future orders do not unilaterally change orders already accepted.
Prices and payment
Prices are displayed in lei (RON). The total price, applicable taxes and delivery cost are communicated before an order is placed. Available payment methods are those displayed at checkout. No additional charges are made without the customer's express consent. For an accepted order, the price and conditions agreed when the contract was concluded apply.
Delivery and transport risk
Delivery options, costs and timeframes are shown at checkout and on the Shipping & returns page. Unless another period has been agreed, delivery is made without undue delay and no later than 30 days after the contract is concluded. In the event of delay, the consumer has the rights provided by Article 18 of Emergency Ordinance no. 34/2014, including an appropriate additional period and, where applicable, termination of the contract and reimbursement within no more than 7 days after communicating the decision to terminate.
The risk of loss or damage remains with the seller until the customer, or a person designated by the customer other than the carrier, takes physical possession of the goods. The statutory exception concerns a carrier chosen and instructed independently by the consumer, where that option was not offered by the seller. If a product arrives damaged, contact us at contact@facutedinlemn.ro. Photographs of the product and packaging help resolve the matter but are not a condition of statutory rights.
Withdrawal, returns and refunds
The consumer may withdraw from the contract within 14 calendar days of receiving the product, without giving a reason. For several products in the same order delivered separately, the period starts when the last product is received. The notice is within time if it is sent before the withdrawal period expires.
You may use the online Withdraw from contract function, also available from the website footer, without a customer account. Enter the purchase identification details and email address, then use the withdrawal confirmation button. You receive by email an acknowledgement of receipt, the content of the declaration, and the date and time of transmission. You may also send any unambiguous declaration to contact@facutedinlemn.ro or to the trader's address stated above. The online form is not the only method of notification.
Return the products without undue delay and no later than 14 days after giving notice of withdrawal, to the return address shown on the Shipping & returns page. You bear the direct cost of returning goods after withdrawal. The cost of remedying a lack of conformity is borne by the seller, as provided by law.
We reimburse amounts paid, including the standard delivery cost for withdrawal from the entire order, without undue delay and no later than 14 days after receiving the notice. The difference for a more expensive delivery option expressly chosen by the customer does not have to be reimbursed. We may withhold reimbursement until we receive the goods or proof that they have been sent back, whichever happens first. We use the same payment method unless you expressly agree to another method, without reimbursement fees.
You may inspect the product to the extent necessary to establish its nature, characteristics and functioning. You are liable only for any diminished value caused by handling beyond such inspection, as provided by law. The original packaging is recommended for transport protection, but the lack of it or of the original invoice does not cancel the right of withdrawal; the purchase can be identified through other evidence.
The exception from withdrawal for goods made to the consumer's specifications or clearly personalised applies only to products that actually meet those conditions, where the customer is informed before ordering. A one-of-a-kind piece already available in the shop is not, for that reason alone, a personalised product. The exception does not remove rights relating to lack of conformity.
Optional notice model: “To NEAGU VLAD CONSTANTIN PERSOANA FIZICA AUTORIZATA, contact@facutedinlemn.ro, at the address stated above: I hereby notify you of my decision to withdraw from the sales contract for the following products: […]. Ordered on […] / received on […]. Consumer's name: […]. Consumer's address: […]. Order number, if available: […]. Date: […]. Consumer's signature, only if the notice is on paper: […].”
Legal guarantee of conformity
Under Emergency Ordinance no. 140/2021, the seller is liable for any lack of conformity that exists on delivery and becomes apparent within two years of delivery of the goods. For notices, write to contact@facutedinlemn.ro, identifying the product, purchase and issue. The legal guarantee also applies to handmade, one-of-a-kind and personalised products.
The consumer may request repair or replacement free of charge, subject to statutory exceptions concerning impossibility or disproportionate costs. Repair or replacement is carried out within a reasonable period, no longer than 15 calendar days from informing the seller, agreed in writing, and without significant inconvenience. In cases provided by law, the consumer may obtain a proportionate price reduction or termination of the contract. If replacement of a one-of-a-kind piece is impossible, the other statutory remedies remain available. These rights are separate from the 14-day withdrawal right and do not require an additional commercial guarantee.
Liability and customer rights
The seller is liable under applicable law for performance of contractual obligations and for the conformity and safety of products. Nothing in these terms excludes or limits the consumer's statutory rights. Use and care recommendations must be followed; every situation is assessed individually, without automatic exclusion of the legal guarantee.
Personal data protection
Personal data are processed in accordance with Regulation (EU) 2016/679 (GDPR) and Law no. 190/2018. Details about purposes, legal bases, recipients, retention periods and data subject rights are set out in the Privacy policy. To exercise your rights, contact us at contact@facutedinlemn.ro. Simply visiting the website or accepting these terms does not constitute general consent for marketing or for processing that requires separate consent.
Complaints, disputes and applicable law
For complaints, contact contact@facutedinlemn.ro or +40 773 314 470 with details that identify the purchase and issue. We aim to resolve matters amicably. The consumer may contact the National Authority for Consumer Protection (ANPC) and use alternative dispute-resolution procedures where applicable. These options do not limit access to the competent courts under the law.
Romanian law applies, including Emergency Ordinance no. 34/2014, as amended by Emergency Ordinance no. 18/2026 regarding the online withdrawal function; Emergency Ordinance no. 140/2021; Law no. 365/2002 on electronic commerce; and Law no. 193/2000 on unfair terms, as in force. The choice of Romanian law does not deprive a consumer of the protection of mandatory provisions applicable under European rules. Jurisdiction is determined by law.
Updates to these terms
Changes are published on this page and apply to future orders. For an order already accepted, the version applicable when the contract was concluded is retained, subject to mandatory legal provisions. Terms cannot be changed retroactively to the customer's detriment.
